1. CONTEST OVERVIEW AND TERMS
Welcome to Intel’s The Intel® Core™ i7 Custom Challenge (the “Contest”), a competition open to individuals 18 years of age or older located in the fifty United States and the District of Columbia, Canada (except Quebec), United Kingdom, Belgium, Netherlands, Norway, Sweden, and Japan (“Participants”) and sponsored by Intel Corporation (“Intel”) and administered by Hawkeye, Inc (“Hawkeye”). The Contest seeks to challenge end-user/gamers to build the coolest looking desktop systems. Interested Participants may submit pictures and a video showcasing our buildup and a short essay describing your submission. The video and pictures will serve to highlight the cosmetic features of your submission. For the purposes of the Contest, Intel defines participants as end-user enthusiasts, gamers and designers. The Participant with the top proposal for each of the following categories will be awarded the designated grand prize package:

The Contest commences on October 5, 2009 (12:01 a.m. PDT) and ends on November 16, 2009 (11:59 p.m. PDT). Winners will be selected on or about December 14, 2009 and announced on or about December 14, 2009.

The following individuals are not eligible to enter or win: officers, directors, employees and contractors of Intel, its subsidiaries and affiliated companies and other individuals or entities involved in the administration, development, fulfillment and execution of this Contest, and their immediate family members (spouse, parent, child, and/or sibling and the household members of each). The Contest is void where prohibited taxed, or restricted by law.  All federal, state, provincial and/or local rules and regulations apply.

The following individuals are eligible to submit a mod entry, but are not eligible to win any prizes: Intel employees, Intel authorized distributors, and Intel channel membership resellers.

Each Participant’s submitted solution and all its contents (a “Submission”) shall become the sole and exclusive property of Intel. The Participant grants the right for Intel to utilize his or her name, likeness, image, Submission, and all interviews and statements made by the Participant in connection with the Contest or Intel’s products or services in any marketing materials generated about the Contest designating the Participant as a Participant in the program if the Participant is chosen as a winner without notice or additional compensation, except where prohibited by law. Participant also agrees to be interviewed by any of our publication sponsors if the Participant is chosen as a winner. Participants shall not receive any compensation or credit for use of Submissions, except where prohibited by law.

The rules, terms and conditions relating to the Contest are comprised of these Official Rules (the “Rules”) and the official Contest communications by Intel. The Rules and official Contest communications shall govern and apply to all participation and activity arising out of and relating to the Contest. By your participation you agree to all such Rules, terms and conditions of the Contest. These Rules cannot be modified or superseded except by Intel, in its sole discretion, in a written revision to these Rules posted to the Contest Website (www.intelcorechallenge.com) and, at Intel’s sole discretion, other potential official Contest communication methods.

2. PARTICIPATION IN THE CONTEST
A. CONTEST ENTRY. To enter the Contest, follow the below instructions. ALL SUBMISSIONS MUST BE IN ENGLISH. Submissions must be received by November 16, 2009 11:59 p.m. PDT. Submissions can only be made via the Contest Website at (www.intelcorechallenge.com). You will receive a Contest confirmation e-mail and access to an account which constitutes official entry into the Contest (each registering party is a “Participant”) and consent to and agreement with the Rules, terms and conditions of the Contest.

HOW TO ENTER:
1. Visit the Contest Website (www.intelcorechallenge.com ) and complete the registration form, including providing your first and last name, registration type (Enthusiast/End User, Intel Channel Partner, Intel Employee), Handle (screen name), email, physical address, country, state/province, postal code, telephone and Avatar. Participants will be required to create a free user account to compete.

2. After an account has been created on the Contest Website (www.intelcorechallenge.com), you will be prompted to upload details about your mod submission. See article six (6) and seven (7) below for file requirements.

3. Categories: You will be required to select from the categories below for your submission. You have the option to enter in both categories but are only eligible to win on one.

    1. Mod Creativity: Who can build the world’s most creatively futuristic mod desktop for powering extra-intense gaming – a desktop that showcases innovations in lighting, cooling, liquid emersion, cut case creativity, and more?
    1. Lifestyle Innovation: Who will develop the world's best and most futuristic home automation platform – making their lives better through wireless media centers, lighting automation, security integration, and more? – Show us how you incorporate and improve your everyday life with your mod. What can it do to make your life easier, and how does it fit in to your lifestyle? Would anyone know it was a desktop if they didn't know it was a desktop?

4. System configuration: You will be required to enter specific details pertaining to the system configuration including: 

    1. Processor used in the mod system
    2. Motherboard manufacturing name and model
    3. Graphic card name and model
    4. Memory quantity

5. Reseller: You will then have the option to select the name of the reseller you bought the processor from to build up the system.

6. Pictures: For all contest categories you are required to submit five pictures of your mod that shall represent the before state of your mod, the front, side, inside, and a free style image of your choice. The maximum file size for your submissions is 4 MB per image.

7. Video: Optionally, all Participants can create and submit a one minute video about their mod. All video submissions will be considered for a special video award. The maximum file size for submissions is 10 MB.

8. You will be required to answer two questions about your mod:

    1. How does your mod desktop bring the future closer to reality today – through either system creativity or lifestyle innovation? (In 500 characters or less)
    2. Describe how the processor inside your mod takes it to another level (In 500 characters or less)

9. All entrants will receive a confirmation e-mail upon submission. 

B. ELIGIBLE SUBMISSIONS. In order to be eligible to win, Participant’s Contest Submission must comply with all of the required contest questions outlined in section A, and meet the judging criteria as mentioned in section D of these Official Rules. Submissions that do not adhere to the instructions provided on the Contest Website or that are lewd, obscene, pornographic or disparage Intel or its affiliates or are otherwise inappropriate will be disqualified at Intel's sole discretion and removed from the Contest Website. Submissions previously entered in other Contests or projects that have been previously commercialized are not eligible for entry in the Contest. Participants may enter more than one Submission provided that each Submission is materially different and distinct from Participant’s other Submission(s), as determined in Intel’s sole discretion. Intel reserves the right to disqualify any Submission at any time, including at the time of judging, for the failure to meet all Contest judging criteria and/or these Rules. Only eligible Submissions are qualified to win. All Contest Submissions must be received by Intel no later than November 16, 2009 (11:59 p.m. PDT). No automated entry devices and/or programs permitted.   Intel is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic.  Proof of submission will not be deemed to be proof of receipt by Intel.

C. JUDGING. All eligible Submissions for the Contest will be screened by a panel of judges (“Contest Judges”), who will score each eligible Submission based upon the judging criteria noted below. Current Judges include:

    3. Lance Ulanoff, Editor-in-Chief, PCMag

Contest Judges are subject to change in Intel’s sole discretion and without notice.

One (1) grand prize winner will be selected for each Contest category by the Contest Judges based on eligible Submissions. Participants will not be eligible to win a prize in more than one category, except for the Best Video prize. All decisions of the Contest Judges are made at the Contest Judges’ sole discretion and are final in all matters relating to this Contest.

D. JUDGING CRITERIA. All Submissions will be judged by a panel.

Submissions will be judged on five factors according to our panel of judges –comprised of sponsors, Intel® employees, and industry experts. Contestants will be awarded up to ten points per factor, for a total of 50 points.

  1. Overall mod creativity.
  2. Mod paint job/creativity.
  3. Technical enhancements.
  4. Demonstration creativity.
  5. Futuristic vision.

Up to the top 30 Submissions that receive the most points according to the Judging Criteria will be entered into the People’s Choice finals competition (the “Finalist Submissions”). Intel will decide any ties based on the Submission with the highest points awarded for the Overall mod creativity factor. Finalists will be notified on or about December 14, 2009 via email as provided upon registration.

From November 23, 2009 through December 14, 2009, all Finalist Submissions will be displayed on the Contest Website (www.intelcorechallenge.com) for public voting. Each registered voter will be eligible to vote once for their favorite Finalist Submission according to the judging criteria noted above. The Finalist Submission that receives the most votes will be named the People’s Choice winner.

E. CONTEST PRIZES. (i). The grand prize for the CONTEST will be given to one (1) eligible Submission for each Contest category specified in the “CONTEST OVERVIEW AND TERMS.” The grand prize packages will include the prizes listed for each Contest category above.  (ii). Prize winners will be notified based on contact information supplied by Participants, the accuracy of which information is the responsibility of the Participants. In the event a Participant cannot be contacted within five (5) days of prize notification as determined in the sole discretion of Intel, or a winner rejects a prize, an alternative winner with the next highest score in the respective Contest category will be selected. Upon prize forfeiture, no compensation will be given. (iii). Any costs, gratuities or expenses not explicitly stated in these Rules as Intel’s responsibility are the sole responsibility of the Participants/winners, including costs and expenses related to development of Submissions.

The total ARV of all prizes to be awarded is $10,300.  Winners agree that all prizes are being provided “as is”, and the Released Parties (as defined in the “No Liability” section below) make no warranty, representation or guarantee regarding any prize, including but not limited to its quality, condition, merchantability or fitness for a particular purpose.  Winners must look solely to the manufacturer of prizes for any such warranties or guarantees, if any.  No transfer, substitution, or cash redemption of prizes is permitted, except at Sponsor’s sole discretion or as otherwise provided herein.  Sponsors reserve the right to substitute a prize of equal or greater value if prize becomes unavailable due to reasons beyond the control of the Sponsors.  No more than the number of prizes set forth in these Official Rules will be awarded.  All prizes will be awarded by January 31, 2010.

3. GENERAL TERMS AND CONDITIONS
A. Entries; Verification/Audit; Participant Cooperation. All activity arising out of and relating to the Challenge is subject to verification and/or auditing for compliance with the Rules, terms and conditions of the Contest and Participants agree to reasonably cooperate with Intel concerning verification and/or auditing. In the event that Contest verification activity or an audit evidences non-compliance with the Rules or official Contest communications, as determined in Intel’s sole discretion, a Participant’s continuing participation in any aspect of the Contest may be suspended or terminated. No responsibility is assumed by Intel for information not received by Participants or inaccurate information.

B. Rules, Amendments and Interpretation. The Contest and its continuing Rules, terms, conditions, benefits and participation are offered to Participants at the sole discretion of Intel and its affiliated companies. Intel reserves the right to amend or interpret the Rules or official Contest communications and any element or elements arising under or relating to the Contest at any time, upon published notice to Participants on the Contest Website (www.intelcorechallenge.com) and, at Intel’s sole discretion. A Participant shall be deemed to have notice of any such amendments or interpretations upon publication of the same on the Contest Website and shall be deemed to have accepted such amendments or interpretations by virtue of a Participant’s continuing participation in the Contest. Should a Participant not wish to continue to participate in the Contest pursuant to the Contest Rules, as amended or interpreted, a Participant may terminate participation in the Contest upon written notice to Intel.

C. Warranties/Disclaimers. INTEL EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND (WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE). NEITHER INTEL NOR HAWKEYE WILL NOT BE LIABLE, AND ARE NOT RESPONSIBLE, FOR ANY DAMAGES OF ANY KIND RELATED TO A PARTICIPANT’S PARTICIPATION OR INABILITY TO PARTICIPATE IN THE CONTEST, WHETHER THE DAMAGES ARE DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL. INTEL RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO SUSPEND OR CANCEL THE CHALLENGE AT ANY TIME FOR ANY REASON.

D. Indemnification. By entering into this Contest, Participants agree to release, defend, indemnify and hold harmless Intel, Hawkeye and their respective parents, subsidiaries and affiliated companies, and agencies, and each of their respective officers, directors, employees and agents (collectively “indemnities”), from and against, and accept all responsibility of any kind, including but not limited to financial, for any liability, claims, losses, damages harm, injury, cost, expense or proceedings (including reasonable attorneys’ fees) whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in the Contest, or possession, acceptance and/or use or misuse of prize or participation in any Contest-related activity and for any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery.

E. Participants Contest Consent and Releases. Winners will be notified based on contact information provided by Participants. As a condition to participation in the Contest and receipt and acceptance of a prize, a Participant may, in Intel’s sole discretion, be required to complete, sign and return a Promotion Materials Release (“PMR”) or other similar form. A PMR will include consent by winner for Intel and those acting under its control to use a winner’s name, likeness, image and winning Submission for the purposes of advertising, promotion and publicity without further compensation or notice, except where prohibited by law. Permission is specifically granted for Intel to promote the winning Eligible Submission in perpetuity in any medium it may see fit including, but not limited to, Internet, Website, television, radio and/or printed materials. Additionally, winners will be required to sign an affidavit representing and warranting that their winning Submission is wholly original and unique, or alternatively that Participant has license or rights to implement the winning Submission as proposed. Participants will be required to sign the PMR or similar form within 15 days of prize notification. If any winner is considered a minor in his/her jurisdiction of residence, the PMR must be signed by his/her parents or legal guardian and such prize will be delivered to the minor’s parent/legal guardian and warded in the name of the parent/legal guardian.

F. Tax Consequences. Participation and receipt of benefits from the Contest may have tax consequences in certain instances. Should there be any tax liability for participation in the Contest or receipt of a prize, or costs or expenses relating to participation in the Contest or for any other reason, such taxes and/or expenses are the sole responsibility of the Participant.

G. Miscellaneous.  In the event of a dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Intel with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Intel that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Intel reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. Intel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Intel is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Intel on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Contest. Intel may prohibit an entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Intel representatives.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, INTEL RESERVE(S) THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

USE OF DATA:  Intel will be collecting personal data about Participants online, in accordance with its privacy policy. By participating in the Contest, Participants hereby agree to Intel’s collection and usage of their personal information and acknowledged that they have read and accept Intel’s privacy policy.

LIST OF WINNERS: To obtain a list of winners, send a self-addressed, stamped envelope by January 31, 2010 to Intel Core i7 Contest Challenge Winners, c/o Hawkeye, PO Box 58423, Seattle, Washington, 98138, USA. Anticipated number of winners is thirteen (13).
